Proposal to Increase Periods of Stay for TN to 3 Years

Post Tue May 20, 2008 2:50 pm

FYI: The proposal to extend the length of stay for TN non-immigrants to 3 years is currently in the comment stage and will be until June 9th. So far, there is only one negative comment and the rest are in support of the change, however, there are not very many comments compared to the number of TN professionals already on the job. I'm hoping that this goes through before the end of the year, especially since we'll have to leave a few weeks early because of the whole Driver's Licence issue! The full proposal and link to add a comment are on the uscis.gov website.

Do you have any idea what is the negative feedback about?

Yes, I do and anyone can read all of the comments online at that site. The one negative comment spoke about saving american jobs and that was about it.

Would you be able to provide a direct link for everyone? I have a feeling most of us weren't aware it was there and available for us to comment on. I'm trying to find it on the site now and am not having much luck.way too much information to dig through. Thank you!

Sure. Here's the link to the article.
http://www.uscis.gov/portal/site/uscis/ ... f3d6a1RCRD
(or uscis.gov and click "more news" to find the link.

Here's the link to the comments.

If they don't link, you'll have to cut and paste.

Still, most are in support with a few sighting job loss.

Thank you! Hopefully more of us will take the time to make a comment now that we know exactly where it is. (I had no idea where to find it.)
Thanks again.

If this rule were to be approved when would it be established? Before presidential elections or after?

Notices of proposed rulemaking can sometimes happen very quickly, or sometimes they just put it on a shelf and it never happens. After 9/11 there were huge numbers of rule changes and they went into force almost immediately after the comment period ended.

This is sort of between the two extremes. Essentially all it does is replace the words "a" with "three" in various places throughout the CFR, so it's hardly a big deal.

So I suspect it will happen, but I doubt they'll do it in a rush.
Steve.
