Qualifying for the TN work visa

Hello! I am a new graduate in Ontario that may be working sometimes in USA soon. There have been concerns my accelerated course does not qualify as the 2 year course required for many of the TN job catagories. I am an honors electrical engineering technician with 1460 hours of instruction. We did more hours, longer semesters and finished in 17 months. Has anyone else had issues along these lines? Does anyone know what "2 years" is defined as bottom line?

You will need to have an evaluation made to determine if the course meets the requirement of 2-year diploma. there a firms that do this.

Shouldn't be a problem since most 2-year diplomas are completed in 20 months. aren't they? I hope you didn't have to pay a premium for this "acceleration",

Keep in mind that for any of the TN categories that accept such diploma, you ALSO need to have 3 years of documented work experience in that field.

8 CFR 214.6 (the regulations covering TN professions and requirements) defines "Post Secondary Diploma" in footnote 3 as:
"...a credential issued, on completion of two or more years of post secondary education, by an accredited academic institution in Canada or the United States."


The above footnote bars non-accredited education. If the diploma is not accredited, a Free Trade Officer could decline your petition. Worry about that too along with the length of the program.

You could get someone denied or even barred at the border with that kind of advice. I think this totally inappropriate in a legal public forum even if devoted more to travel issues. Be careful posting in the future.
