Que: re answers to the forms for TN renewal by mail

Hi,
I'm about to give these forms to my employer to extend my TN but I have a couple questions.

On part 2 of the I-129 form - information about this petition, I am fuzzy on what to put here. Would I tick box 2b - continuation of previously approved employment without change with the same employer? Because if I tick that, then it asks for my petition receipt number, which I have no idea what that is. Also then on part 2 question 5, I would be option c to extend the stay of the person(s) since they now hold this status?

Another question is about part 4 question 8 - asking have you ever been given the classification you are now requesting? (which is a TN and yes I have). If i answer yes, then I must explain on separate paper. Is this just explaining I've received a TN before and dates etc. It seems like they're asking the employer this, not me. Must they explain they've asked for me to have a TN before?

Fiestagirl,

Yes, on Part 2, you would tick box 2(b) and write "N/A" for the petition receipt number.

I am not certain of the answer to this part. From what I have heard, others have left Parts 3 and 4 blank and just stated their I-94 Number. There is no way that I can 100% verify that though. Even a mail-in I-129 not completed properly definitely has the potential to go wrong so you want to make sure it is done right. If you are still stuck, consider a quick consult with a legal professional.

Part 2, Question 5 is choice (e) since you were petitioned under NAFTA.

Make sure to mail it to the correct Service Center which is Vermont. I recall a person who trusted his HR Department to do this and they mailed it to California which was the wrong Center. Then he had to go to the border to get a new TN and encountered some rugged CBP Officers who denied him and revoked his old TN. They disallowed any further TN's under that category. He had to readjust to life in Canada.

Make sure that story does not happen to you.
