guys;
my contract with my company where i was working on a tn visa ended around 3 weeks ago. i have been on vacation for 3 weeks.

glad to say that i have found a new job its a company based out of Toronto but do some business in the US as well

i am going for a management consultant tn.
i will have the following items

bachelors degree in business admin
tn letter
resume

Should i take the letter from my previous employer or the degree should be enough. Did anything else changed in one year with regards to tn visa?
my current tn expires in 4 days

thank you much
in advance

You should be fine, although in my opinion, it would likely be better, unless this Cdn firm has a US operation, to get the TN sponsored by the client, and not the Cdn company. Not absolutely required, but the TN is best sponsored by a US entity. The risk is the border might (repeat, might)deny you TN and say that you should be entering on B1 business visitor status, which is fine as an entry status, but requires that you maintain residence in Canada. But it is possible and legal for a Cdn firm to sponsor and obtain a TN for its employee to work in US, no question.

Otherwise, nothing has changed in terms of TN requirements. MC TNs are most scrutinized, as ever.

You should be asking this on a TN immigration forum, like
http://forums.immigration.com/forumdisplay.php?f=244

But do realize -- as an aside -- that, although the I-94 you were issued has an expiry date in the future, you became out-of-TN-status 3 weeks ago. So, I trust you left US at some point in the last 3 weeks, and did not re-enter US on that invalid I-94? You could be asked about your whereabouts for the past 2 weeks.

Wow thanks for the prompt reply.
I was under the impression that i knew so much on tn's but after your reply i realize how little i knew and how much their is to learn.

I wasn't much clear about my departure in my earlier post.
I haven't left the US i was on vacation for the past 3 weeks, tomorrow will be my last day officially. ( i will get paid for working tomorrow) and will leave first thing Saturday morning, my tn expires on Monday so hopefully same day i will try to go to one of the border post to get a new tn.

On another note, the canadian firm has a US operation, however the letter is signed by HR Director in Canada, as they have no management personal located in US. I did discuss with hr about getting a tn from the client but it was a no go with them

I am lucky to get a job at this stage hopefully the border person will be nice and won't give me a headache.

As you explain the vacation, your situation is fine.

Let us know how it goes on the Cdn company TN attempt.

Will do for sure,

PS i did get my letter today it looks ok however the letter was stuck with the envelope seems like a little tear on the top if you look very closely just asked them to send another one :-X

Called one of the border post the gentleman informed me the company should be located in US and that's it but i am thinking its one of those things that depend from person to person.

Will keep you guys posted
