If a company in US is willing to hire you but they won't sponsor Visa, could I still apply? I know I am eligible for TN since the job relates to software engineering and I am a Canadian and hold an Electrical Engineering degree from a Canadian University.

I don't see why you couldn't apply and then discuss with your employer. I would assume that when they say they don't want to sponsor a visa, they're probably referring to a H-1 or a mroe expensive visa, as opposed to the $50/year TN.if you go there with all the information about TN and explain that all they have to do is write a letter, they may be more open.

I'm not sure you could get TN-1, "software engineering" as a job is not directly related to electrical engineering, depends on how closely they scrutinize the job offer letter and how its phrased. If they put down "programmer" instead of "engineer" then it's pretty likely you'll have problems.

It specifically cautions that engineers without software or computer credentials may not fill computer related jobs under TN category.
