hi reba you helped answear my questions so far about immigration issues, i have 1 more question ,i have received a notice for an interviw form 1-485 appplication to register permanet residence or adjust status,from my previous posts you said that i was in a pickle ,cause of the way that we moved to usa and applied for the status adjustment,wouldent they send me a deny notice and a court appearance to leave the country if it was that bad of a situation ?or do they still do the interview waste your time a bit and than deny you? 1 thing went well so far, my son received his usa citizenship,cause my wife is usa citizen, he a year old i wish it was that easy for me lol

If you're going to be denied, they'll do it at the interview, not by letter. They may not even give you a decision on that day, but may hold you up for administrative review or some such, and then send you a letter with their final decision. Which may or may not go in your favour, I dunno.

One thing to remember however is that a denial decision on adjustment of status based on marriage is usually not appeal-able (is that a word?) and you will have to leave the country in their time-frame given.

Or they may not give a hoot and they'll stamp your passport no questions asked. I've heard/read various opinions on similar situations, but I don't know the outcome so that's about all the help I can offer at the moment.

It all comes down to the mood of the interviewer on that day, and how you answer their questions, and your intent upon your last entry to the US. And how the planets are lined up and so on and so forth.

hello just updating my case ,any how i have received my work permit in june ,,i have went to the interview about 4 days ago ,and i have been aproved and waiting to get my green card in the mail ,the lady that was interviewing us also stamped my passport so i can go to canada and wont have any trouble gettin back in ,the interview was like 20 min long she just double checked if every thing was correct on the papers and that was it,asked a fiew questions and she was jokin around with us wasent excpecting that lol,but for now my plans are go 2 canada visit my family havent seen them for almost 8 months.

This is a poor forum for immigration matters, especially complex ones.

You should consult immigrationportal or others. Better yet, See a lawyer about this.

Reviewing your other posts, I would say that you have been ill-advised by amateurs (not reba, but the religious organization). Remember, that group is one of the biggest proponents/supporters of the 12 million illegals here in US, so legal immigration is the furthest thing from their expertise.

These days, it is almost unheard of to even have an interview for I-485, so just the fact that you have one should worry you.

On the bright side, immigration thru marriage (which despite the irregularities in your case, is what you are doing) has all sorts of waivers of penalties, illegal presence, etc). There is little chance that they will kick you out of the country, since you will simply start a new legal process outside US. you have the legal right to be in US, you may simply have some 'splainin' to do.


An I-485 decision can is [b]always [/b] be appealed (your marriage will not be deemed fraudulent) but you want to avoid that.

why? he just said he'd had his interview and was granted his green card.

Congratulations bart! Which office did you have your interview at? I forget where you said you live. Arizona?

Sounds like you had an interviewer like my husband and I did. She just kind of flipped through our paperwork, asked us what date we got married, and that was it, she stamped my passport. We were so disapointed that we had lugged around this huge bag full of evidence that my husband started pulling out photos of our dogs to show her! LOL. *snarf* It was very anti-climactic. I'm glad yours was too.

Not everyone has an interview? How common is it to have one?

Almost no one in EB catageries has interview. If your are getting conditional FB green card thru marriage (lees than 2 years), then you're 99% likley to get interview.
