Question on Mat Leave, EI and relocating to USA on H1B Visa

Does anyone have the answer to below handy?

Currently I'm on Mat Leave in Toronto and expected to go back to work in Feb 2012. Turns out while on mat leave, my husband got a job in the USA on a H1B visa so our whole family is relocating to CA. We're expecting to move Nov 2011 and assuming nothing goes wrong, I will not be returning to work when my mat leave ends, obviously. I already gave my employer the heads up and plan to give my resignation at that time.

However, I thought I saw online Employment Standards that I can still collect EI up to the end of my Mat Leave even though I will be in the USA for 3 months of that EI time (Nov-Jan). Is this accurate? And if not, what number do I call to let them know to stop sending me Mat Leave EI as of the last day I'm in Canada?

Yes, you are entitled to mat benefits regardless of where you live (unlike regular EI benefits). Be sure to contact service canada to tell them, so that they will withhold 15% tax on those benefits. You will need to stp any GST and CCTB payments.

CRA has a great Emigrants guide that hepls with this.

You will become a Cdn non-residnet the day you move to US, so will be filing a departure return for 2011.
