Questions about Immigration

Hi Everyone,

I'm new to this site and searching for a bit of advice. I have been backwards and forwards about Visas etc .... Heres a bit of my story:

I am engaged to a British man born and raised. I currently live in and am a Canadian Citizen. We have been long distance dating for about a year now. Hes come to Canada and returned to the UK and I have been to the UK twice to visit him and meet his family etc..
These are my 2 biggest questions:

I would like to apply for a fiancee visa or a spousal visa but I have an 8 year old daughter with whom I share "Joint Custody" with her father but have Primary residence with me. I am the one who makes all decisions in regards to religion, healthcare, schooling etc etc. Her dad lives a province over and talks to her maybe once every 3-4 months. He doesnt pay support and is an alcoholic. It states in our divorce agreement that I am allowed to relocate outside of where we live with 30 days written notice, and it also talks about his access to her with his alcohol problems etc. I am the one that makes all decisions until he can prove he no longer has an alcohol problem. I need to know whether I need to go after "sole" custody which he may not give me, or is just his permission enough??

Also, the question about why doesnt he move here?? Well he recieved a simple caution 2 years ago for cultivating a marijuana plant. It was a simple caution, but I'm afraid CIC will reject his visa application, even though its already spent. Its the only other option if I can't leave Canada with my daughter.

Any help would be so appreciated !! This has led to many many sleepless nights for me.
