quit current job and go for a different US job

Hi folks,

I am facing a very difficult situation right now. I just started on a new job under TN Visa. However, I was approached by another US company I applied quite a while ago for a job that is much more appealing and is in the same city as my GF does.

 The tricky thing is (I don't want to let my potential employer know that I have a job right now. I know it is not a honest thing to do, but I can't let the opportunity slip away)

What 's going to happen to my TN visa ? Can I simply go to the border office and tell them that I was terminated from my previous job and here is a new offer again ?

Just quit and re-apply or have the other employer file an I-129 to add them to your TN-1. Quitting and re-applying is quicker obviously. And cheaper too usually as I-129 costs $320.

If you are changing employers, you will require a new TN (new I-94) for the new employer. If you are coming back to a port of entry for a new TN, you may surrender your previous I-94 to Canada Customs on the way back into Canada. As you re-enter U.S. Customs, you may apply for the new TN for the new job.

Whether you physically travel back to Canada or do it through the mail, one thing is clear, the cost is similar since USCIS has pushed through big price increases for mail-ins and the like. Either way now, there is a pretty sizable cost of doing these things. For example, the cost of doing a mail-in renewal ($320) is now comparable to a flight back to the port of entry for a 'new' application or TN.

I am still in Canada right now. How do I cancel my TN Visa status ?
Should I just go to another border office ?

When you go to the POE hand in your I-94 and tell them you want to apply for TN-1 again with a different employer.
