Re-Entering the US with the TN-1

Post Fri Dec 21, 2007 6:38 am

Hi.
I am making my first trip back to Canada as a TN-1 holder and am wondering if there will be any hassles at the US border on my return. Has anyone ever had a problem re-entering the US, with a valid TN-1?
Thanks,
jomo

A current valid TN, no. I have crossed dozens of times. Make sure you have your passport, obviously.

As with all customs agents, don't be nervous or overly friendly. Answer their questions truthfully but don't embellish at all. Don't strike up a side conversation. Don't ask about the weather or the guy's life or appeal to their sense of humor. They don't have one.

If you can, don't get a female or a young male, they tend to be on power trips. Get an older male. Usually you don't have a choice but sometimes you do.

Renewing a TN, oh yes. Hassle *every* time. I'm on my 6th. It is something I have come to dread every year. Have fun with that.

You shouldn't have any trouble.

Answer any questions, directly - don't start rambling on.
They may ask questions to determine your "intent" -- pay attention and be polite.

Its almost always better to file a TN extension with USCIS in my experience. You don't have to depart the U.S., do not face direct and inappropriate questioning, and the CIS officers are more knowledgeable. I've never had a problem renewing a TN with USCIS. Another benefit is this: if for example your TN expires on February 1, 2008, as long as CIS receives the TN Petition before or on that date, you have implied work authorization for up to 240 days while they adjudicate the petition.
