Hello,

My family and I will be moving to the US next summer. My husband is a US Citizen. We've been married for almost 3 years. My son is 9 months old.

I'd like to know what forms we have to fill for our green card. I am aware my son can get automatic US Citizenship because of my husband being American. We are going to the embassy on Friday to report his birth in a foreign country so he can probably obtain his citizenship.

While you're at the US consulate registering your son's birth abroad, you can get the I-130 petition form started. The consulate can process the petition, but once that is approved, your visa application and interview will be at the US consulate in Montreal. They're the only ones who process immigrant visas.

You'll need to submit the I-130, the G325A forms, plus a copy of your marriage certificate, US passport style photos for both of you, and if either of you were previously married, you will need to include copies of the previous divorce decrees or death certificates (however the previous marriage ended)

This page has all the info you need on it, read it carefully because it's hard to understand in places.

The usual thing that seems to trip people up is that the sponsor (US citizen) must be up-to-date with their US tax filings. US citizens must file a 1040 return every year, even if they live outside the US. If their tax home is another country then they must also file Form 2555-EZ or 2555. Provided their income is below the foreign exclusion limit ($87,600 in 2008) plus deductions etc. then there is no US tax to pay, it's just paperwork.

You can also apply for an SSN for your son through the consulate.
