My Story:

I came down over Easter weekend to visit my girlfriend, and she asked me to marry her. I didn't come down on any visa. We got married April 11th, 2008. I have been down here ever since. I have some immigration forms but am not sure if I have all of them or which ones I need to submit all first or all at once.

Question:

Which forms do I or my spouse need to fill out and submit to: #1 Petition for me, #2 Get employment permission #3 Gain residency.

If anyone could fill me in on those details and kind of layout the path for me that we will be following, that would be great.

Thanks,

Rick

You will need to file the I-485 (application for permanent residency), I-131 (travel visa, only good for 1 yr) and the I-765 (work visa, also only good for 1 yr). Your spouse will also need to fill out the I-864 (affidavit of support). The I-864 will need to be filed with the I-485.

Make sure that you keep copies of everything that you file.I'm sure you will need will have to re-apply for work and travel visas again. And it will also help if you ever decide to file for citizenship (N-400).

check out uscis.gov for more info

Good luck!

Thanks for the info. I heard that there is a petition for alien relative in the mix too.

I am wondering which ones I need to fill out and submit first, and then which ones I will need to file subsequently after confirmation from the first ones. ALSO, when do I need to have that immigration medical done and fingerprints done?

go to www.visajourney.com for information on marriage based immigration, then go directly to the Guides, (there's even example forms) and the Adjustment of Status forum
