Regarding Arrest Record

Post Mon Nov 17, 2008 4:08 pm

Hi All,

In 2007 me and another friend were arrested for "communicating for the purposes of obtaining the service of a Pros." (it was an undercover female cop) - we both chose to complete the diversion program which requires that we complete the John School Course. Upon completion all our charges were withdrawn and since we didn't had any criminal record, we were never required to have fingerprints or pictures taken.

The information I have is that I don't have a criminal record on file but I do have a arrest record (and it will show under Local Police Search) and that it shows charges are withdrawn because of successful completion of John School program.

Now I will be finishing my university and am planning to travel to US. I wanted to inquire if I will face any problems while travelling to US or not. (and if I do what problems can I expect at the Border)

Thanks.

If you have no criminal record, you should be fine. The arrest record may or may not show up with a passport scan. Your best option before you make any travel arrangements is to call US CBP or Immigration to find out if your arrest record makes you inadmissable.

An arrest record generally doesn't make you inadmissable unless it's a drug-related offence or "moral" crime, which this is. However it won't show up in CPIC so I can't see how USCIS would know unless you tell them.
Steve.
