rejected at TOR today

After two successful TN visa, same company, same job, same document, I got rejected this morning in Terminal 3.

In a nutshell, my TN letter is very unprofessional (can't blame nobody, it is done by the previous office manager,who doesn't know much about TN anyway), but magically it worked twice in Buffalo, the officer in TOR airport seems to be much more strict.

A few obvious mistakes:

I don't have a degree in Engineering, so "Software engineer" is not good title. I need to be under Category "Computer System Analyst" .

the letter should address to CBP, not US Immigration....

My degree is in Mathematics, but it is with Business Administration/Information System. So, it doesn't sound CS enough to those CBP dudes...I am not sure what can I do about this one ...


One thing learnt , if you get rejected , you actually get flagged in the system. I was foolish enough to try the Buffalo location, and the officer there gave me a really hard time... (even though he is the same person that approved my TN visa two years in a row)

Definitely a terrible way to start 2011...

You are flagged. period. You will have trouble crossing from now on, even just to buy gas, regardless of where you cross or fly from.

That is the problem when you get TN approval on shaky grounds. You never can plan when your time will be up.

The adressee was a minor issue, the guy was just being picky. The other issues are likley insurmountable.

Is my situation really that bad ?

I am going to have a lawyer to work on my TN letter and documents.

Worst come to worst, can I at least go back to US to get my stuff ?

They might let you back in on a short visitor status (issue you an I-94 in B2 with a 2-3 week expiry, but they are fully within their rights to insist you first re-establish Cdn residence (proof of lease, utilities, etc) before letting you back.

But, whatever, I don't mind moving back to Canada.
