Rejected twice on my first TN extension

Post Tue Aug 19, 2008 12:18 am

Hi, everyone,

I was trying to get an extension for my first TN as computer system analyst, but rejected twice in different POE. The reason is that they think my role is actually a computer programmer instead of a system analyst. The officer threat that I may be forbidden to enter the US forever. I still have my car and stuff in the States, if they really do that then I can not even collect them back to Canada. Can they really do that?

Does anyone know any good lawyers? prefer in Vancouver or Seattle area, who is able to help me on this situation? Will a new offer letter from the company with new job responsibilities work?

Thanks,
Bill.

Thanks for your reply.
I went to the ground port at peace arch (between Vancouver and Seattle) in my first try, and then at the Vancouver international airport the second time.
My job title is Computer System Analyst, and I have a bachelor degree and a master degree on Computer Engineering.

Do you have any recommendation for lawyers in Vancouver area?

Surprisingly as Peach Arch is usually very good. The reason they denied you at Vancouver airport also includes the fact that they thought you were border shopping. Is your education from North America? Did the duties include programming? If your present TN is not expired you could also file at a service center.
If you need help call USAD immigration they offer a free assessment and are real good. Good Luck

I think you are right about the border shopping part. My education is not from North America, but I have done an equivalent evaluation in University of Toronto for both of them. So they didn't really point to my education part. My duty does include programming, that is the place they said I am not a system analyst. Unfortunately, my TN is expired now. Do you by any chance have the contact for USAD immiration? Thank you!

Systems analysts always do programming, if you do DBA you have to run SQL queries and basic administration requires scripting.

My suggestion would be to try as a computer engineer if all else fails, there is a NAFTA category for "engineers" too.
Steve.
