Renewal of TN visa

Post Fri Mar 14, 2008 6:44 am

My TN visa expires in May - and I should be renewing it. Should I only do a border crossing to renew at the date of expiry, or can I do it before hand (e,g. one month before)?

Thanks

You should reply at least 1 week before it expires. The agent could get grumpy if you do it on the expiry date. I know as this happened to me in 2004 and it delayed what is normally a 30 minute exercise into a 5 hour delay at the border before it was finally approved.

Can anyone assist? I'm currently in the US on a one-year TN that expires on Jan. 31, 2011. My application was denied the first time, reapplied one week later and was successful. My employer wants to extend my employment for roughly 1 to 2 years. He has everything prepared, but has asked me to review the documentation for him. I'm having some issues with Part 4, Question 8 (a) & (b). The first question, 8 (a) asks whether the beneficiary in the petition has ever been given the classification being requested. He answered "NO", but I think it should be "YES" because by classification it means status, and I did get my TN status in February of this year. Then the second question, 8 (b) asks if the beneficiary has ever been denied the classification now being requested. He answered "NO" to this as well, but I think it should be "YES" because my application was denied the very first time at the border. Can anyone assist?

Thanks,
Nikki

Read the question carefully, it says that this question applies for NEW petitions. Yours is an extension, so technically, you don't answer the question.

If you decide it is better to answer that you previously had a denail and an approval, the employer would explain this in the expalantion page at the end of the I-129.

Either way it won't matter
