Renewing TN Question

Post Wed Dec 26, 2007 11:59 am

Hello!

For the record, I love this Forum!

i like many people am currently coming to the end of my TN status. I'll be renewing it at the Windsor/Detroit border (I've heard horror stories of that POE) using the engineering technician/technologist classification. It went extremely smooth last time, so here's hoping it works out the same way again.

Is there anything me/my employer need to change on the TN letter? (besides the dates)
I was thinking instead of it saying "A one-year term" it should say "An additional one-year term"

Thanks So much :)

Treat the "renewal" like a new application. In the letter, change the dates. Do not state "additional year". Keep it simple, state "one year term."

Good Luck!

When I am married to a US citizen, will that cause any problems renewing my TN status?

Lying to immigration and customs officials is never a good idea. Not ever!

They may or may not deny a TN visa based on your marriage to a US citizen.

What are your future plans? Do you plan to just keep on renewing your TN, or do you plan to apply for a green card eventually? Or move back to Canada eventually?

We haven't decided what our best course of action is.
We will speak with a lawyer in the near future about it.

As it stands now, I'll most likely get started on the green card process after I renew my TN, to avoid any delay in my eligability to work.

After marriage, I believe filing for an EAD, and an I-130 is my best bet, but still a little unclear of the details.

Try the tunnel, not the Bridge, and request to see Officer Carter.

There's a few questions I was hoping to get answered.

1. Is there anything me/my employer need to change on the TN letter? (besides the dates)
I was thinking instead of it saying "A one-year term" it should say "An additional one-year term"

Additional one year term would be fine. Make sure any change in job duties or salary are reflected.

2. This has been answered before somewhere, but I was hoping for a bit of clarification. Soon to be married to an American, is there any way I can apply for something else while on my TN Status? I really don't want to fall into that pit where I'm not allowed to work for a certain period of time.

Where are you marrying? In the U.S. or Canada?

3. my Fiance will have her RN shortly, would it be easier for her to get permanent residence in Canada rather that me staying here in the states?
