Renewing TN Visa after it expires

Hey!

My TN Visa expires August 7th. I will be leaving San Fran and going to Canada (Montreal) on August 7th and staying there for vacation until August 18th. I plan on "renewing" the TN Visa at the airport on August 18th.

They told me last year that you cannot really renew a TN Visa, it's a new application, so, I decided it doesn't matter if I do this after my Visa expires, say on August 18th. But, maybe I should do this on the 7th.

What do you think? Would it be possible to "renew" my Visa on the 7th at the airport when I land in Canada then? Should I even bother to do this?

Also, should I modify my TN letter to say "Kat has been working here for a year and we have decided to renew her Visa for another year term". Or should I just leave it where it says "We would like to hire Kat for 1 yr".

Should I also update my resume to reflect my years work at this company?

Hi Kat,

You renew your TN Visa upon re-entry into the U.S. In your case, it seems this would be after you've completed your vacation in Canada. You have two options to renew, either by mail or in person at the border.

For future reference, the cost of renewing by mail is being increased significantly as of Jul 31/07.

Ensure all your documentation is up to date - including your resume. In case it is requested by the Immigration officer.

Is it Ok that i'm getting a paycheck on the 16th while my visa is expired? I will not be working, but I will be paid. is this a problem?

Hi,
I have a couple of questions regarding TN visa. I am working under TN visa and in the visa, the expiry date is 10/23/2009. I am to work for the same company after that date for another 8 months or so.
1) Do I need to leave US and cross the border and get a new TN visa on my way back to US, or I could do it inside US. If so, how, and how long it takes?
2) Generally speaking, after the TN visa expires, how along more could one stay in US?

1) Your company can mail in an I-129 to extend your TN. It takes 2-3 months typically, but during that time you remain in TN pending status and can work.

2) A few days is acceptable. Alternatively, you could file I-539 and request B2 visitor status for upto six months to wrap up US affairs.

After the TN expires they usually say its about 10 days give or take.

Some members have been on this forum for days, some for months and some for years. Why are we crowning people as "verterans". Really now? Give me a break. :-|

And while I understand that facts are facts and that laws are written, one shouldn't be critical or demean another individuals perspective on immigration laws. Even if another members information is off who are we to smack them down? There are tactful ways of correcting one another in the event someone is misinformed. I have to say I'm a little annoyed with the KNOW-IT-ALL stance certain people present on this forum. I come on here quite often and hate to see the "You're wrong this"... Or "Let me clarify" that. There are ways to correct other members without being offensive.

Isn't the point of this forum to help other members sort out their visa issues? I don't get it! :-X

The best way to help someone asking a question is to -- above all -- avoid giving incorrect or misleading information.

The best way to help those who answer a question is indeed to point out the error, or to clarify where appropriate. Their next answer will be better for it.

And yes, I have been answering questions for 9 YEARS, on sites that deal specifically with Cdn-US tax, finance, immig issues (including this one in the past). Don't let the "Joined date" fool you.

These forums only get better, only "help other members" when incorrect statements are challenged, debated in the open, and hopefully put to rest.

Otherwise misconceptions like "TN can't be self-employed", "One can't visit US for more than 6 months in a year", "one can't apply for GC while on TN" fester and grow roots.

I'll accept your concern about tone. You should read some of my earlier posts :twisted: . I've mellowed. It's a journey. I try to avoid "you are wrong", better "that answer is wrong, here is the correct one", no?


Nowadays, for this veteran, it's all about giving accurate and helpful answers to the one asking the question.
