Resident alien, adresse in canada

Post Fri May 22, 2009 7:45 pm

I've been working under TN since 08. I was renting an apart with my wife/ children in Canada till March 09. now I have no physical adresse in canada but I still have my bank account there. I called my bank to inform them of my adress here in US, they said they need a canadian adress.

1. Do I have to have a physical adresse in canada?
2. Do I have to keep a residence adresse in Canada to have the chance to renew my TN.

can u explain to me what to do?

thanks a lot

and other question,
Now I have to prepare my tax return in US, and there is a place where I have to give my adresse in Canada.
I could not write my old adress in canada because I felt not legal to do so.

what do you suggest?

You should borrow a Canadian address from a friend or better yet a relative while you are on a TN in the US. You will need to establish non-immigrant intent the next time around when trying to renew your TN visa. If you don't have a physical address in Canada, chances are, your TN will not be renewed.

Depends on the bank, usually not.

2. Do I have to keep a residence adresse in Canada to have the chance to renew my TN.

It's not required under the regs but you are required to be in a "temporary" position and the easiest way to prove that is to have residential ties to Canada, which would include having a residence, although there are other methods you could use.

The address on your tax return is just a mailing address, use your current address.

Bear in mind your residential status has a major bearing on your tax filing status, i.e. whether you are resident in Canada for tax purposes or in the US, and that has a major bearing on what paperwork you're supposed to file.

Read IRS publication 519 and this: http://www.cra-arc.gc.ca/E/pub/tg/p151/README.html

TN-1 is awkward when it comes to taxes because to show you are there as a "temporary" worker you can keep residential ties to Canada, but if you do that you are resident in Canada for tax purposes as far as the CRA is concerned.
