Retaining Canadian Citizenship By Descent

Post Tue Jun 28, 2011 11:57 am

I am a Canadian citizen by birth (in Montreal). My son was born in the United States (in Boston). He is a Canadian citizen by descent (first generation.) He already has a Canadian passport. My son is 9-years old. We live in the United States.

At some time in the future, will my son be required to perform any act to retain his Canadian citizenship? For example: sign a declaration, or spend a certain amount of time in Canada. Thanks for your advice.

No. He will retain his citizenship forever (unless he formally renounces it). This has been always the case.

However, his children (your grandchildren) will not get Cdn citizenship at birth, unless they are (a) born in canada, or (b) the child's mother has Cdn citizenship by birth or natuarlization (that is, otherwise that by descent).

In the past, your grandchild would get conditional, expiring citizenship, but would then have to move to canada at some point before a certain age, or that citizenship would be revoked. This was causing too much confusion, so canada adopted a regulation much like the British have, which is that one simply cannot pass on citizenship if it was recieved by descent.

Thank you. That's what I thought, and it's good to have confirmation.
