Return to CAN as employee of a Foreign Firm. Carrying on Bus

I am moving back to Canada and wanted to explore the opportunity of continuing my relationship with my employer.

Employer is not conducting any business in Canada - all within Offshore, US and UK.

Am I correct to asuemm that i can remain an employee of the foreign firm - which is simply required to withhold and remit tax, CPP and EI?

To remain an employee, you will need to paid on a Cdn payroll. It is easy to have the firm do this, but many firms are unwilling, because there is some minor Cdn tax exposure that they just may not wish to bother with. The fact that they have no operatin in Canada would make them even less likely to want to undertake this relationship.

Unless you are getting a REALLY good pension (employER-funded) from this firm, I would opt to become a contractor, with a big bump in remuneration, and take care of your own expenses and taxes as a self-employed.

Otherwise, you are paying for overhead and benefits that you cannot use or do not need.

Thanks for the response. When you say a small amount of tax exposure - where does this come from? From what I can see - if you do not carry on business in canada, you do not need to set anything up.

You are an employee in canada. The employer has to set up a payroll.
