I think Mari-mac is right? What exactly is the visa type in your passport?

If you have been living in the uk legally for the last 8 years you should have Indefinate leave to remain or at least the possible right to apply for this.

It all depends on what your visa currently says.

Yes my right of abode on my expired passport does not work because it is only valid with an passport that is not expired. I have a new passport and need to get and right of abode to make it valid. I have been warned last time I came back from Canada that they may not let me in because of this.

Okay that's a little clearer. From what I understand, again after having lived in the UK you should definately look into indefinate leave to remain which *I believe* would allow you to travel with a british passport. however I can't remember exactly as it's been awhile since I've looked into this.

I do recall someone mentioning that it is possible to transfer your visa etc to a new passport however there *is* a fee involved to do this.

I would suggest contacting the Canadian embassy or the British consulate to obtain more information on your options.

This is a link to information I found on the subject at the Durham university website:

This page mentions reapplying for Right of Abode - but it seems to mention the same form that you've already said:

Riverfox - as far as I understand, Right of Abode is higher than Indefinite Leave to Remain - so if you moved back to Canada, you would still retain RoA to return to the UK, but your ILR would be lost.

However, as melo has lived here for than 5 years, you could also apply for British Citizenship, and become a dual citizen.
