Running the grey under TN/I-765

Well, my biometrics were done on July 9yh so that's done with.
My lawyer is adjusting my address so that is getting cleared up.
The only thing worrying me is trying to keep the job while waiting for I-765. I don't mind not getting paid or being off the payroll, problem is I don't want to raise red flags or cause problems for the new job.
I'm really not sure how I'd get caught in a matter of 3 or 4 weeks but I'm sure they have their ways.
I'll have to talk with the employer about keeping me off payroll for another few weeks.

You actually cannot even "volunteer" at a job, or "intern" unpaid without an EAD.

Afraid you'll just have to wait it out, and if your potential employer can't wait a few weeks for you, well, you'll have to find another job once you do have your EAD in hand.

Steven, even on TN if you marry a US citizen after entry on the TN you can adjust status based on marriage. The same burden of proof is on the applicant as on someone who entered on a tourist visa and married and stayed to adjust however. They have to prove that the intent to get married and stay was not there when they entered the US. If the IO determines that the intent was there, then the AOS can be denied and the applicant can be deported.

The other thing to bear in mind is that just because you've filed an application doesn't mean they will approve it. All kinds of technical BS reasons it might get turned down. If it gets lost in the mail you'd be even more screwed, look at what happened to that Polish researcher because they didn't like her photo!
