Seeking Legal Advice & Possible Lawyer to handle my L1A Visa

Post Mon Dec 19, 2011 7:08 pm

Hello

I wish to get some advice on L1A and also seeking possible lawyers who can help me prepare for L1A.

Here is my situation

I am a Canadian citizen who had L1A from Company X. I had that for two terms. First time 1 year and 2nd time 3 Years. Which expired on April 2010.

Company X is no longer in business either side of the border. The last time I went to US on L1A was in Dec 2009. However, since then I have been visiting many many times between Canada and USA for personal and business meeting purpose. No issue there. I also hold nexus card.

Now I have a business in Canada which has been running since 2009. I also opened a simillar business in USA for the purpose of US Presence and Banking in 2009. However I am not on the US business Payroll. US Business Corporation and Bank account is being used for the purpose of Sales Transaction. Clients Pay US company, US Company pays Canadian Company (via invoices) and thats it. I am getting my salary from my Canadian company.

I have hired a part time consultant in USA to handle my US operation. Since it is mostly for Transaction, small office is there in New York. The consultant is paid via Invoices. I also use Outsource company in USA to handle my US day to day receptions services. All calls are directed to Canada after the initial phone call. North American business are conducted in Canada while Rest of the world is being handled from our Dubai Office in UAE.

I own both companies. Now it is time for me to expand my US Business since the economy is starting to pick up for my line of business. So i want to focus on US as a major area. I have to train local people in USA to start training clients and do local Sales.

I wish to re-apply for my L1A Visa. Should I do it use my existing US Business Account or should I open a new business under different state? Idea is to expan the Canadian operation in US for US market. Right now all the US client comes to Canada for the service. Now I wish to offer my serivces in USA.

I am doing my taxes this month for my US companies. So all taxes should be all clear and it is on positive terrority. What I would like to know is can I use my existing US corporation to act as a subsidy of Canadian or do I need a new one?

If you are a lawyer, what would you say an estimate cost would be to budget for this. I dont have much time to prepare the document myself as I am traveling every month. So I wish to hire a decent lawyer who can help me prepare for all the documents

My qualification:
- I am well known Engineer in the world for my line of business
- I have been highly recommended by over 100 IT Professionals on LinkedIn for being subject matter expert in this field.
- I have many published materials that I sell online - Lectures, labs in DVD format.
- I have all the certificates that is needed.
- I have over 15 years experienced in this field.
