Self employment in the USA

Post Wed Feb 01, 2012 2:21 pm

Hello everyone. Im a licenced realtor currently living and working in Ontario. I'd love to sell properties in the USA (Im with Remax btw) but Im not sure if that would require a visa, as it is self employment.
My wife has been looking for jobs in the USA and recently got invited for an interview. IF she gets the job, she qualifies for a TN vida and my understanding is that I would qualify for a TD vida but could not work there.
Any options for me?

Thanks.

Unfortunately not as many options as one would hope. It is unlikely you'd be able to get any kind of temporary work visa as a realtor and it is, indeed, true that a TD status is easy if your wife has a TN but you cannot work on the TD.

The only option is that if she qualifies for an EB1 or EB2 green card, she could persuade her new employer to move expeditiously on sponsoring her for a green card. That would allow you to get an EAD (employment authorization document) and you could work, including as a realtor.

If she qualifies only for an EB3 green card, then the waiting list is very long (years) unfortunately.

I just register a consulting business in Toronto and at the same time got a job offer from a company in Alabama.
What's my best option: To be a sub-contractor or let the company hire me as their employee.
I have PR status in Canada and don't want to lose it.
Thank you.
