Share your experence for Vancouver airport TN1 petition

Post Sat Sep 18, 2010 11:32 pm

I have got a job offer as a computer systems analyst from a staffing company. I have a bachelor degree in computer science and 10 years experience. I am planning to apply for TN1 in Vancouver Airport. Does any body has bitter experience in that POE. Specifically, I want to know how they react for staffing company job offer letter. I know Toronto airport US immigration does not accept job offer letter form a staffing company.

You have the correct education to obtain Immigration Status as a Computer Systems Analyst so I suspect your application will go pretty well. Vancouver PFI should be reasonable. There have been numerous reports regarding CBP Inspectors along the Washington State ports such as Peace Arch and Blaine Truck Crossing. Just avoid those crossings as the officers have been very aggressively denying petitions that were clearly eligible for TN Status.

Toronto does accept petitions from Staffing Companies but sometimes the officers do get it wrong.

Thanks for your reply. I have another issue to discuss. I had been working with TN1. But, I lost job one month before because of budget cut of my project. I applied to change my status to B2 within 10 days and got approval. Now, if I go to the border to change the status to TN1, will they ask me any questions about my B2 status i.e. how you got the job while you are in B2 status? you are not supposed to look for job in B2? etc.? Did anybody has gone through similar situation? please share your experiences.

There is no problem with this situation. You were in legal status, found a job, and are now applying for your work authorization.

There is nothing illegal about looking for work while in US in another status. What is not permitted is lying about your intentions when entering US (ie. "I'm on vacation", when really you are job-hunting).

Presently, my wife, children and me are in B-2 status. I was the principal applicant when I applied for B-2 status through I-539. Now, I want to go to the border alone to get the TN. As soon as I change my status to TN, will my family become out of status as I was the principal applicant for B-2. If my family do not become out of status, how do I change them to TD. Can I change their status with out going to border?

B-2 is not a dependant status, so your status is unimportant. They remain in B-2 until I-94 expires or they leave US, whichever is first.
They need to go to border and get TD or apply using I-539 -- BEFORE their current I-94 expires.

I am very curious about the Blaine Peace Arch and Truck Crossing problems people encountered there.

I had all my TN's (except the first one that I got in Cornwall, ON) processed at either of the above.

The last one has been quite hard to get. First, they denied it because my documents were not all in English. Strangely, it was the first time this was a problem. The, I came back with all my documents translated and Notaried (by a US notary) and they barely accepted.

If you can tell me a border that normally is smoother, I will try it next time.

Thanks!

Jean
