Should I apply for the TN Visa?

Should I apply for the TN Visa?

Hello,

Thus far this site has been amazing and very helpful in my situation. I am aware of the TN Visa and am seeking some advice. I just graduated in July with a Masters in Accounting in Alabama. I also have my undergraduate degree in Accounting as well. I landed a job with an accounting firm and currently have been working for them as a Staff Auditor using F-1 OPT status. The job is full time and I am on a yearly salary. I love it there and definately do not want to lose my job over immigration issues. My HR manager has no experience with immigration so I have put alot of responsibility on my self to reasearch the situation.

Some legal advice has been given to me and the TN Visa seems to be my best option. My profession falls under its list, I am Canadian and have the appropriate education. My only concern is that I know the TN Visa is for temporary employment for up to 3 years, but the position I hold has no time limit and it is just a regular full time job. How do I avoid being denied this Visa because my job is full time?

Also I am currently working in Alabama and was wondering if my best option would be to file a COS (Change of Status) or travel back to a POE (Ex. Buffalo/Fort Erie border crossing) to apply in person?

My OPT does not expire until Sept.1, 2012 so how soon can or should I start applying for the Visa?

Thanks for all the help that I have already found and hope someone can grant me some specific advice. :)

You are eligible for TN. Even thoufgh the job looks permanent, they will simply hire you temporarily, for upto 3 years, and can renew this indefinitely.

To make you permanent, they would have to go thru the steps for GC, including an extensive employee search for a qualified US worker.

There is no hurry to get on TN. If you are planning to leave US any time in the next 8 months, you can do it on your way back.
