Should I use a lawyer to get a spouse visa?

Post Sun Jul 25, 2010 6:03 pm

Hello!

My husband was born in Canada to a British-born father, thus making him a British Citizen by descent. We have just applied for his British passport and assuming all goes well with that, we intend to move to England.

Now that his passport application is out of the way I've been looking at the application for a spouse visa and am a bit overwhelmed. Has anyone managed to successfully apply for a spouse visa on their own, or is it better to get the help of a lawyer/other expert?

I'm looking at the form and there are some questions that are kind of vague. For example, it asks when my husband became elligible to live permanently in the UK. Would that the be day he was born, since technically he was a British citizen since birth? Or would that be the day his passport is issued, since that was the day he got "proof" of his right to live in the UK? Also, it asks me to list "any criminal convictions including traffic offenses." Does that only include traffic offenses which are in contravention of the Criminal Code of Canada, e.g. DUI? Or is that referring to ALL traffic offenses, even those that violate the Traffic Act, such as speeding tickets and such?

I've sort of gotten myself into a position where I'm now slightly paranoid about the details. Are spouse visas really that hard to obtain, or am I overthinking things?

Thanks! :D
