You still must meet the requirements of a tourist, which is maintaining a home in Canada, and leaving US after 6 months.

Anything that exceeds this would need to be requested from US immigration, and would be up to them. You *might* be able to extend for 6 more months, by mail, by filing I-539.

But remember, by spending a lot of time outside canada, you risk losing YOUR healthcare.

I'd rather be with him once he still alive, be with him as long as I can.

My wife was petitioned by her father back in 1992 as a family class immigrant.

Her case has since been reclassified to a married child of a US citizen from a single child of a US citizen. My children and myself have been appended to the petition. It seems that her case will be coming up for an interview date with the US consulate in Montreal in the near future (probably April or so) and we have already been asked to submit the DS-230s, police clearances etc.

It doesn't seem like there is any big hurdles or problems with the petition so we hopefully anticipate obtaining the immigrant visas.

I wanted to ask in general what most people do with their financial dealings here? I understand I will be subject to an exit tax (I believe it is more like they tax you earlier?). I wonder what would be best to deal with the RRSPs and RESPs we have here? We own no real estate so that would probably be our foremost concern. Is it generally best to liquidate and take the tax hits before departing for the US? I understand RRSPs are covered under a tax treaty but you still have to declare them in the US and some US states still tax them even if the federal level exempts them (intention is to settle in Arizona and it does have a state income tax).

Any opinions/advice would be appreciated.

Do not collapse your RRSP until AFTER you leave canada.

But you can keep RRSP while in US, and it remains sheltered. Only California taxes RRSP year-by-year. You need to move it to a Cdn broker like TD waterhouse though. the banks won't deal with none residents.

Any other non-sheltered investments will be 'deemed' to have been sold on the day you leave, and any tax resulting from such 'sale' will be owed to Canada -- and then that's it.

Take a loof at the "Emigrants" guide from CRA.

How about my children's RESPs? I understand there is no tax treaty to deal with them?

I guess my information is a bit dated if California is the only hold out state left then.

Oh lordy what we do for love!
I am a Canadian madly in love with an American boy. I have been down here visiting for 5 months and I am getting ready to head back to my job in Canada. There is nothing harder for me then leaving the man I love but I have no intentions of staying here illegally and I most certainly don't want to tick off the wrong people and not be able to come back. I want to return in 3 or 4 months and I am wondering if a) I will have trouble getting back in the country b) if I should apply for a fiancé's visa before I get here or when (or if) I get back. I have seen a lot of different comments on this board different timelines and different sites and I am lost. I would love any insite from anyone who has been through or is going through anything similar to me. Thanks.

does bachlor of fine arts count as TN visa?

Suppose I was accepted as teacher's aide or resident advisor in USA and gets a letter stating I gets a job offer (no sponsor), does US Immigratin requires what follows on job description such as bachlor of education, even thought if I pursue bachlor of fine arts? Or must follow from TN list? IS there any changes as Obama is president now.

I want to stay in USA, in southern state such as arizona because I can't stand cold. (yes you probably heard many times)

Please let me know
Thanks
