Sponsoring Canadian Spouse

Post Wed Jun 22, 2011 3:58 pm

Hope someone can help me?

I married my husband, who is a Canadian citizen in the fall of 2000. I am a US citizen. We married in the US & I moved to Canada in 2001. In April of 2005, I moved back to the US & he stayed behind to sell our house & then his dad became ill & he's still in Canada. He's been driving to Ohio ( where I live ) using his vacation time to spend here in the US. We are now ready to start the immigration process to get him here to the US with me. My questions are:

1) He stays in Canada while I send the forms in correct?
2) How long will he have to wait there until he can come here & look for a job?
3) Will he go to a Dr. in Canada for his physical that they do?

Sorry so many questions...unfortunately I'll probably have more..lol.
Thanks in advance!

Visajourney.com(VJ) has all the FREE info you require!! Look at the CR-1/IR-1. Since your married fo rover 2 yrs, your going for the IR-1, which means he will get a 10 yr greencard once the process is over. Process ifor CR-1/IR-1 is the same. Just if ur married less than 2 yrs, your going the CR-1 route and the initial greencard is valid for 2 yrs!!

1) He can still visit you while the process is ongoing. Up to Poe Officer. Ensure he has strong ties to Canada with him when he crosses (Letter from employer, mortgage/lease papers, utility bills, proof that visa paperwork has been filed, etc etc)

2) Once he has the IR-1 and then moves to tthe USA, he can start working ASAP! Does take a few weeks to get the SSN. What has happened to others on VJ that started working ASAP,was that employer held their paycheque until they got the SSN, then got paid!

3) Yep, medical will be in Canada by an US Immigration approved Dr. Only a few places in Canada that do them--all on VJ

4)His interview will be in Montreal--simple as that!! As its the only USA consulate in Canada that does the CR-1/IR-1interviews!!

5) The process is easy enough, step by step form instructions on VJ, its the waiting that will kill ya, can take anywhere from 7 months to well over a yr to go from submitting ur first form to the actual interview!!

Check out VJ, lot of great info. READ THE GUIDES OVER!! No 1 cares more about ur case than YOU!! So take time and read things over!! At the top of VJ their is even a link to EXAMPLES OF ALREADY FILLED OUT FORMS!!!

http://www.visajourney.com/forums/forum/93-canada/ where many of the Canucks hang out

1 item many Canucks are not aware of---is the if he has enough qualifying hrs, he CAN collect Canadian Unemployment Insurance when he moves to the USA. Leaving ones job in Canada to move to be with a spouse is acceptable!!

Best of luck
