Spouse settlement visa - is this the right one?!?

Hello,

My husband and I are Canadians (born and bred) and he holds a British passport/citizenship. He just received a job offer in the UK and plans to move next month.

I need to decide what visa to apply for. I am looking into the visa that allows me to settle as a dependent of my British spouse. The application seems to assume that my husband is living and settled in the UK (which he is not. We don't have an address, UK bank, etc. etc.).

Is this the correct visa application for me to make? Has anyone been through the process and do you know how long it will take?

That might assist you.

I think you can apply for perm residency as you are his wife.

When you say you think it assumes that your husband is settled is that because it used the terms settled? If that is the case then it doesnt mean he has to be settled there now. Just means he is planning to come with you

It explains what it means by settled. Im no expert but hope that helps you out a little bit. If that doesnt work drop me a line before 2AM Mountain standard time with any questions you and your husband have and i will ask them for you.
Im asking some questions for my Canadian girlfriend tonight so we can move from Calgary to the UK. We are in a similar situation as yourself. Im a British Citizen.

Settled’ means being allowed to live in the UK lawfully, with no time limit on your stay. 'Present and settled' means that the person concerned is settled in the UK and, at the time we are considering your application under the Immigration Rules, is in the UK or is coming here with you, or to join you and plans to live with you in the UK if your application is successful.

Thanks for the reply!

I applied and submitted all the biometric data on Tuesday. Do you know how long it will take? The response from Ottawa has been vague. They say it takes 5 - 15 days for non-settlement cases and longer for settlement cases.

Hi Sharonb!

Just wondering what the outcome of your post was.how long did it take to receive your visa after application?

I am living in Winnipeg and marrying a British citizen and resident this summer. We are trying to do everything in advance. Do you know if I can get the biometric data done before making application?
