Spouse visa question!

Post Fri Oct 28, 2011 9:30 am

Hi there,

Can anyone who got married in Ontario and then applied for a UK spouse visa tell me just how long the whole process took?!
Looking stuff up I find it takes 10 weeks just to register the marriage..before you can apply for a certificate. Which I will need to get my passport in my new name (my passport expires two weeks after the wedding and I thought it better to apply on my new last name rather than just renew my passport in my maiden name?)
Then when I have that, apply for the spouse visa.

So..marriage..ten weeks or so..however long it takes to get the certificate, depending whether I pay extra to get it fast..apply for passport, same deal as certificate..apply for visa, do world bridge appointment, then wait however long it takes them. Does it really take 2-3 months before I could be living with my new Husband?!

Or If I apply for a fiance visa, get married here as planned, is there a way of switching over minus the certificate, as I could be waiting nearly two months for that in any case? This is all so baffling to me :( I can't find straightforward answers anywhere, without having to pay $2 a minute to World Bridge, who probably can't help me anyway!
I liek caek! (guinness caek!) And men in kilts, RAWR!

Its better to consult that to the embassy or to the immigration office near you. They will provide to you the right information that you need to your problem and also they will tell you what to do about it. And also try to ask an attorney that are expert in visa and immigration issue for the support information of your problem. Goodluck!!

For what it's worth (my partner and I have also looked into this), marriages in Scotland are registered MUCH faster than marriages in Ontario. From what I understand (though I'd suggest you call a local registry office and double-check), if you get married in a registry office in Scotland, the marriage will be registered the same day and you should be able to get the legal certificate within a week or two.

I don't know where you live or if this works into your wedding plans, but it may be something to consider. Bear in mind that if you do not already live in the UK on another visa (e.g., Youth Mobility, Student, etc.) but do intend to settle there immediately after marrying, you'd have to get a fiance[e] visa first, which is quite costly! If you're currently living in Canada, you could go get married in the UK, bring the certificate home to Canada, and then apply for the spousal visa by post from Canada.

To get married in the UK, a Canadian citizen would need either a fiancé(e) visa or special visitor (marriage) visa depending on his/her intention.

If he/she intends to settle in the UK after the wedding and his/her partner is a British citizen or a permanent resident in the UK, he/she would need to apply for a the fiancé(e) visa.

On the other hand, if his/her intention is to go leave the UK and live in another country afterwards, he/she would need to get a special visitor (marriage) visa.

Of course, if someone already lives in the UK with another immigration status, they could get married anywhere in the UK provided they meet their local Registrar requirements.
