Spouse visa questions and more

Hi everyone,

This is complicated, so I'll try and simplify it.

- I am Canadian and my fiancee is British.
- I have a valid working holiday visa until May 1 2005.
- I have been back in Canada with my fiancee (who is on a Canadian WH visa until August 2005) since September 2004, for school.
- Fiancee has to go back to the UK for the summer, and I would like to go with him.
- I have to come back to Canada in September to finish my degree, and he would like to come with me.
- We both want to get married, and think now would be a good time do it, and would make it easier to stay together.

Here are my questions:
1) Should we get married & apply for the visa in Canada or do it back in the UK?
2) If we get married in the UK would I be able to switch my visa status from WH to spousal?
3) If we cannot get a marriage visa, can I stay as visitor in the UK directly after my WH visa, or would I have to apply for a visitors visa or fiancee visa in order to stay?
4) Would our marriage visa for the UK still be valid even though we know we'll be returning to Canada in September. We want to return to the UK permanently in 2006.

I know this is complicated, and I have tried finding my answers in all the normal places, but have had no luck.
Is anyone brave enough to tackle these questions?

you need to apply for the british visa from outside the UK.

Hi there. I will help as best I can as I was in a very similar situation.

I am Canadian born and raised and my new husband is English born and raised. (met in Calgary). Okay....I spent time living in S'hampton with him after engagement and we learned from a visit to Canada House in London that applying for his Residency into Canada would move more quickly if we applied from UK - even though we would be living back in Canada after marriage while waiting for application to approve. He stayed in Canada as a tourist and left after the 6 months, went home for a visit and then returned. 1 year later when application was approved he left Canada for London and stayed a few days before returning as a landed immigrant. (a requirement since we applied from UK)

I can also add that applying for his residency into Canada is alot more costly than if you were to apply for settlement into UK. (1500 as to 600) + medical exam that he will be required to send along with his application (extra cost) My husband and I are married almost 2 years and he has been a resident now for 1 year.

If my memory is right - it would have taken 2 years for me to be eligible for UK settlement as to his 1yr to 18 months for Canada Residency.
