Basically I have a question that I really hope someone can help me with Smile

When I was 19 years old, I went to the US to visit my american boyfriend for the summer. He has family in Canada, and visited quite often, and we had known each other for years. I loved America, and after staying the summer and going back to Canada, I was already anxious for my next visit. When I was 20 I went back to visit again, and this time, my boyfriend proposed, and I being young and stupid, accepted. We got married, and he promised that he would take care of all the paperwork needed to allow me to stay in the United Stated. Unfortunatley things were not what they were cracked up to be. After about a year and a half with nothing being started, me not being able to work and things.not working out to say the least, I packed up and moved back to Canada.

That was almost 3 years ago now. I am in my second year of university back here in Canada, and I have since moved on with my life and put my past behind me. However, I still miss America. I am planning on applying to a university back there, and going on a student visa as a transfer student. Before I do this however, I am wondering if I will have any problems since I did a few years ago, overstay the time I was permitted to stay. Will this be held against me?

Yes, most likely it will be held against you unfortunately. I think there is some sort of waiver application to overcome inadmissability for overstay, but I don't know much about it. You may want to speak with a US immigration lawyer who may be familiar with it.
