Study Visa to the US

Hi,

I am a Canadian PR and leave in Montreal and have a 10 year visitor visa to the US. However, i am also married to a US PR in Ohio and we have filed for my papers to the US. I am intending to study in the US next fall and was wondering if i have to apply for a student visa to the US; if my 10 yr visa to the US will be affected and also if my marriage will affect the visa process.

Yes, you will need a study visa of some sort. It will likely cancel your 10 year visitor visa, as you cannot hold to types of visas to the US at the same time.

As you're married to a US LPR, you may or may not be eligible for a student visa, as you obviously have immigrant intent if you have already started the petitioning process. Can't hurt to try I suppose though.

You need an F-1 visa probably, the college will provide you with an I-20 which you use to get the visa, requires proof of funds. Failing that it will be M-1 (vocational study) or J-1.

If you're married to a US LPR though then CBP will probably think you have immigrant intent, which makes any non-immigrant category tricky.

Thanks for your advice. What if i go ahead and study in the US without the student visa?

The college/university is unlikely to let you enroll unless you do have the proper visa.

fiance visa is only an option if the US half is a citizen. The OP said the spouse is only a PR in the US.
