Switching employer and new TN

I am changing employer and have to apply for a new TN. I don't want to quit my current job until the new TN gets approved (I have to give two weeks notice to quit my job). My current TN is valid for another six months. I guess I can I apply for a new TN without quitting my current job since multiple TNs are allowed. I am planning on applying at the boader. I understand that the validity date in my new TN will be on the date I apply but I still have to come back to my old job for another two weeks until I start my new job. Would I be able to work for another two weeks with my 'old' TN? Will my 'old' TN still be valid once I get a new one? Thanks!

Anyone who needs to work for multiple employers at the same time is eligible for multiple TN's. But of course that isn't your real intent--you just are hoping to use the multiple TN's to reduce your risk.

I would look at why you feel there is a risk that the new TN would be denied. If you are a in a 'slam dunk' TN category I would not worry about it--anyone changing jobs faces far greater risks in other areas than the risk you will be denied.

If, OTOH, you are in one of the trickier TN categories, then remember that a denial of the new TN could also cause them to scrutinize your existing TN. They can scrutinize existing TN's on any entry, so there is no guarantee that you'd able to get back in with your existing TN.

I think if there is a real risk, then there's going to be a risk no matter how you play it, and I think you need to analyze your situation to decide whether it is worth it to switch jobs at this time--while also considering the competing risks of staying in an old job that presumably is no longer right for you.

Thanks for the reply. I'm an accountant with CPA so I don't have to worry about the TN catogory. I have to be in Canada for personal reason so I want to apply for new a TN when returning back to US. That way I'll save money and time. Though I have not officially resigned from my company, they do know that I'll be leaving soon. My only concern is if I'll be able to come back and work for two weeks in my old job (with my old TN) once I get a new TN for the new company.

It is always best to secure the second TN before giving upfirst one or even giving notice (notice is always optional, never mandatory).

Your 1st TN will simply become invalid when you quit.

The only issue is whether the POE will grant your new TN if you are not quite ready to start at the new place. Some POEs are sticklers on this.

Sorry everyone, I'm gonna bump this up.

I am changing jobs and have not yet secured a TN for the new position. Is there a grace period allowed for receiving the new TN in the case where I begin the new job immediately?

For example, if I quit the original job on a Wednesday and start at the new job on Thursday and apply for entry as TN that weekend or the following week.

Perhaps it would be permissible if the induction paperwork (including Form I-9) were completed after I re-enter with a TN, and in the meantime unofficially start my job?

This would be classic illegal work. This is not a game.

No TN for that employer in hand, no legal authorization to work. Period. You aren't stating new job until you return from the border.

Yes absolutely make the trip BEFORE you start.

You (or your employer) may have been confused about the fact that there is, in effect, a 72 hour grace period after starting a new job to do the I-9 paperwork. This is just a short grace period on the paperwork--it doesn't allow you to work for even an hour without authorization. You still need to have work authorization from the moment you set foot in the workplace on your first day of work. The employer then has 72 hours to document your status via the I-9 form.

Also, to the best of my knowledge, TN I-94's issued at the border are never back-dated, even by a few days. You can't turn up on Saturday 1/28 with an offer letter dated 1/26 and hope that the TN will be back dated to 1/26. At best the TN will begin on 1/28; at worst you could be denied/barred if the illegal work is discovered.
