Switching Jobs on a TN visa

Postby justifun » Tue Oct 16, 2007 4:10 pm

I am a canadian citizen and my current job is ending and so does my TN visa i have. I understand that i need to leave the country within 10 days of my visa expiring.

1 - What do i do when im leaving the country to prove that i've left (hand in the TN visa to the canadian border guards)?

2 - I am currently looking for a new job and hope to get a new TN visa with a different company before the other expires, however if i am unable to, can i return to the US as a visitor for the 6 months im allowed, the day after i leave and hand in my TN visa?

3 - Is it any more difficult to switch jobs and get a New TN visa as if i kept the same job?

You don't have 10 days to leave the country, that's a myth. That concept is often applied to H-1Bs but its not in Federal Regs.

You have to depart the U.S. immediately.

You should hand in your I-94 card to Canadian immigration.

Your'e not permitted to seek employment as a B-2 status visitor.

Good luck.

Thanks for the info. Can i turn around and come right back for like a month on vacation? or should i wait some time in between trying?

Also, should i submit a i-539 to allow myself to stay longer that way?

If you truly intend to re-enter the U.S. for vacation time, and don't intend to seek employment, then this would not be a problem and you could immediately re-enter after surrendering your I-94 card to Canadian customs.

The re-entry is an implied 6 month period.

You can't extend B-2 status with an I-539.
