Switching jobs on TN

Post Thu Jul 07, 2011 7:06 pm

Hi,
I am trying to switch jobs, I am currently on TN visa and need to get a new TN for new company. My question is do I need to resign from my current company before I can apply for a new TN Visa? I was planning to go to the boarder next week and get a new TN and resign from my current company once I get the new TN on the same day and start the new job. Is that possible or do I have to resign before I go to the boarder?

You do not need to resign; you can hold 2 TNs simultaneously.

You go to border, get 2nd TN, then return to Job 1 and resign, give notice, etc. To resign before getting second TN is suicidal.

If you truly intend not to work for Firm A as soon as you get new TN for Fimr B. then hand back the old TN at the border once you get the new one. Otherwise, if you paln to give notice and finsh up ina couple of weeks, hang on to both old and new TN.

well the problem is I went to the boarder yesterday and I told them I am here to get a new TN visa so I can start my new job and I was going to resign from my old job as soon as I get this TN and head to the new job. and the guy told me this is "pre -judicatory" and I can't do that. I can apply for a new TN when my I am heading to the new job right away. so I don't know what to do! I do not want to resign and quit my current job unless I can get a visa and from my experience at Blaine Truck crossing nothing is 100% there even thou I have all proper documents and it has been reviewed by 2 immigration lawyers already and they told me it is solid.

Yeah, you mispoke.

You should have said that you were starting your new job, and will then quitting your old one. This is done all the time. Your paperwork for new TN should be worded so that it allows for immediate start.

Do NOT quit until you get new TN.

You weren't required to offer any informationabout the old job.

thanks! that helps.
They always ask me when was my last day at my old job?
I am planning to go again next week early in the morning and tell them I am starting my new job the same day and my last day at my old job was the previous day. Is that sufficient or will they take my other TN away?
