tax & dual permanent resident status

Post Fri Mar 28, 2008 8:28 pm

I became a canadian permanent resident 6 years ago. i have been living in canada and attending university here.
i'm one month away from taking the oath becoming a canadian citizen.
my parents moved to US a couple of years ago and i was granted US green card a year ago.

how am i supposed to report my tax for year 2007? i go to school here in canada, and i am a full time university student here.

i really have no idea.

but i filed my 2007 tax to CRA already. am i supposed to file a report to IRS?

Thanks in advance~!

p.s. i've been searching online regarding tax regulations, and i figured i'm neither canadian living in US nor american living in canada. i have permanent resident status in both. i'm really confused. please hep~!

That's a tricky one. If you are a permanent resident of the US, you don't qualify for the tax treaty exemption. However, as you are not physically there you don't have to file a tax return in the US unless you meet the residency test requirement for 2007 (check on the IRS website to work it out, basically 183 days, however if you were in the US for certain amounts of time in prior years you may be resident).

However, if you don't file a 1040, you may put your PR status in the US at risk. I think you have to apply for a re-entry permit, check with USCIS.
Steve.
