Tax Help. Live in Alberta, Canada work for U.S

Post Thu Dec 03, 2009 10:59 am

Hi,

I am living in Canada on a Permanent Residence Visa. Can I work from home in Edmonton, Alberta online with a U.S company.

My company want to take me as an U.S Employee so that i can get stock options & other benefits. What type of visa is required in U.S for this so that i dont have to travel to U.S but I can work for the U.S company as an Employee. How they will be deducting taxes. Will it be like double taxation for me because I have to pay taxes on my earning to Canadian Govt. too.

Other option is that i register as a small business company or self employed in that case what will the benefits that i am eligible for. From the forum answers it seems that you have excellent knowledge of taxation. what are your charges for tax advice?

Note: My Company is ready to pay any type of consultation fee to you if you have answers to there questions.

Regards,
Rupinder

To work for a US company while remaining in canada does not require any visa. You would only need US work authorization while working in US.

But to work as an employee of the company, they MUST pay you as a Cdn employee, which means Cdn tax withholding, EI, and CPP. Any other form of employer/employee arrangement simply isn't going to work, as you are not liable for US tax, and they will not be correctly accounting for Cdn tax and CPP/EI if they treat you as a US employee.

They can of course simply contract with you as a self-employed person, in which case they simply forward you the entire payment, and you are responsible for Cdn taxes and CPP. You get no benefits.

This is not a tax forum, and is not even run by a tax firm.
