TD Procedure

I am planning to fly up to obtain/renew my TN Visa. I wanted to know if the TD renewal for my wife and 3 children can be done at the same time - without flying everyone back up?

Essentially, can I carry their passports and make the application at the same time? I really - really - need help on this one.

No they have to apply in person. If you're not in B-2 status you could all file with USCIS and not have to depart the U.S.

Thank you. I am not sure what B-2 status is but I will try and see what I can do to find out. My TN visa expires on April 9th, so I fear I may be stuck having to pay the airfare for 5.

If at the last entry you did not receive an I-94 card or stamp then its B-2. (Unless it was a business trip)

Thanks again. Yes I have my I-94 card. This is the first renewal so I am at a bit of a loss when it comes to applying without exiting the US. Is there a resource to obtain this information to get this done, and do you think I have enough time to get it done (April 9th Visa expires)?

As long as you file before April 9, you're fine. My website has information on mailing in a TN petition. Your wife and children need to concurrently file an I-539 to extend TD status.

Don't do it on your own, its too complicated. Its not like going to the border and dropping a support letter on CBP's desk.
