TD VISA information

Hello,
I have TN visa, just got it a couple of months back, my wife is not a canadian citizen but I have heard that you can get TD visa for spouse, but I dont have any details on that. My wife already has usa visitor visa. Please help.

Yes, there's another thread on here about this; if you do a search you will find it. But you will need to get an appointment at a US consulate in Canada to get your wife a TD visa.

Is she already in the USA? If so she could apply to change from B2 status to TD status without leaving the USA to apply for a visa. She should wait until more than 60 days have passed after entering the USA as a B2. She could then apply for the actual TD visa during her first trip out but the timing of that is more at her leisure--there is no rush to get the actual visa if she is already in the USA in TD status and has no immediate travel plans.

If she's outside the USA she needs to apply at a consulate for a TD visa.

Basically she gets the TD the same way she got the B visitor visa, the only real difference is that she needs proof of your TN-1 status (copy of your I-94) and proof you're married (marriage certificate). Other than that it's an identical procedure.

If she's in the US on B already she can file an I-539 to change status to TD, but she can only do that once she's been in the US at least 90 days. The app says files 45 days before you want the status to be effective, so that means she needs to file 45 days after entry.
