Thinking of moving to US

Post Sun Jul 04, 2010 7:04 pm

We are a family of three thinking of moving to the US. There are a few things to consider however and we can't make sense of anything from what we've read:

1) My fiancé's family is American. She does not have American citizenship herself, but could get it... we just don't know how.

2) Her son was born in Canada. How does this affect him?

3) After we are married (in october), how can i go about the process of getting dual citizenship myself?

5) I work in Canada, and do not plan on quitting my job. IE: I would cross the border to work.

4) How can we, given the above, purchase a home in Vermont (specifically) or elsewhere in the US and be able to live there on a full-time basis?

1) she needs to work on this.
2) the child will be if she is
3) you need to marry, get GC, live in US 3 years and then apply
5) same as #3. You would be considered to live in US.
4) You need to marry and get GC first

Why can I not get a GC if I work in Canada?

You certainly can get GC almost as soon as you marry; you specifically asked about dual citizenship.

However, rereading what you wrote, you could live indeed in VT (after you get GC) and commute to canada for work, and then in 3 years get citizenship. I incorrectly interpreted that you would be living in Canada. It's living in canada after GC that would delay citizenship. I have amended answer #5.

Yes, u need to work on your wife getting her citizenship. Once that is done, you can then do what is called DCF (Direct consular filing)this does not happen over night though, used to only take a few months, but lately has been taking upward of 6 months! Visajourney.com is a great free site nad has its own DCF and canada forums! Most of us just hang in the Canada forum! If one goes that route, interview will be in Montreal. All DCF (in ur case its stil a CR-1 visa) have their immigration interview in Montreal. Montreal has thrown a new wrinkle into the process and they want the USA citizen to show proof they are living in the USA or soon going to be! And for some the proof that they had shown was not strog enough, THUS the USA citizen moved on his/her own and established residnece in the USA--the Cdn part of the equation stayed in Canada! Once the process is over, some do live in the USA, but continue to go and work in Canada! 1 of our VJ members, lives in the USA but works as a Cdn Customs guard! Best of luck
