I am new to this forum and have some questions.
This is my current situation:
I am a Canadian citizen and working on a H1B. My company has filed for a PERM (labour certification for GC). The PERM is currently pending and still in process. I am very close to 6 years on H1B.
I own property in USA where I currently live. I have parents who live in Canada and own property in Canada
I may be laid off from my current job. Therefore I am looking to find another job in USA and it may have to be on a TN-1. And when I do, I will quit my current company.
Questions
1) Can I go on a TN-1 after just coming off a H1B? Will I be denied since I have shown prior intent to stay in USA? Does this show up on the border's computers?
2) Do I have to declare my property in USA? Why not just give my parent's address in Canada as my place of residence?
3) Will owning propery in USA be a liability when applying for a TN-1? What would happen if I just didn't tell them that I own property in USA?
4) With a PERM application in my history, will it hurt my ability to get a fresh TN-1?
