TN-1 for Management Consultant with BA and MBA

Good day to all,

I have some general questions regarding TN1 for a Management Consultant.

We are looking to hire a person part-time to act as a marketing consultant. They will be filling a temporary position for one year, advising our executives on how best to develop new customers, produce marketing material and help us reach international customers, specifically in French-speaking regions, including Canada.

She has a bachelor's degree in Political Science and an MBA with three years experience. The TN1 management consultant requirements state a bachelor's degree, but it does not specify a field of study. There is really no such thing as a bachelor's degree in "Management Consulting". The position is not permanent, not full-time and definitely not supervisory management. She will work in an advisory role.

What are your thoughts? I don't see why this would not work, but maybe you all have some different ideas.

The key is "related" degree or related experience.

Her degree would need to be in marketing, or her FIVE years experience would need to be in marketing; then she could ably consult in that field.

Otherwise, its a tap dance at the border. MC TNs are most scrutinized/rejected because they typically are borderline TN qualified, and not qualified in any particular TN field (otherwise they would be getting TN in that field).

The other terms of the arrangement would be favourable.

She could of course work from canada without restriction.

Her MBA is applicable in business development and marketing. She does not have five years experience.

Sorry, missed the MBA part. That certainly would help, if it was marketing-rich. But strictly speaking it is her bach degree that is primary. Once the officer has to look at the curriculum make-up of one's degree, chances get slim.

I assume that she is either living in canada or married to someone working in US. If the former, she should simply consider establishing a business and contracting with you, coming to consult with you in US from time to time on B1 status.

If, as I suspect, she is living in US (as TD or H4 spouse) then she would really need a TN or H1

I just got my 3 year from Buffalo. I have a BBA and MBA as well. The MBA certainly helps.

I was asked before submitting anything if i had a degree when i told them i have a MBA it was really simple from their.

It's the bachelor's degree I worry about, since it's not a BBA degree, just a BA.

Also, as for her situation, she's not married yet, but she does have a significant other in the US.

"Worry"? Most hirers don't "worry" about potential employee qualifications, nor do they know much about their personal life.

Sounds more like you are trying to create a job for someone who is already a friend -- or more.... :wink:

I am not worried about her qualifications, I am sure she is competent. I am worried about the visa process.

Her significant other works for our company, that is how we found her.
