TN-1 Visa- Hotel Management Question (w/spouse)

Post Mon Jul 25, 2011 11:37 pm

Hi everyone,

new to the board, have a few questions about a TN-1 Visa, hopefully someone here has some insight. I apologize if the questions I ask are repeats!

I am currently working in Winnipeg fresh of a Bachelor of Arts-History and a 2 year diploma in Hotel-Restaurant Management, with currently 2 years of hotel experience.

My plan is to gain more experience in Canada and hopefully move to the US in the coming few years. Ever since I was a kid I would have loved to live in Las Vegas or LA. I have travelled both cities extensively and love the south west.

Ideally I would want to get on with a company here in Canada that has hotel locations in CA or NV so a transfer would be easier. Does anyone know how often hotel's might sponsor people down to their US properties from Canada?

Also, I plan to be married when I move, my girlfriend is an HR specialist, not sure if she would fall under any TN-1 Category? How would she move with me then for work?

Also the definition of "hotel management" is somewhat broad, my specialty is hotel sales, and would ideally be searching out a marketing or sales position at a property or high end restaurant in these cities. Technically this is "management" but its not a hotel GM or anything like that. Anyone know if this poses a problem on the TN-1?

Any extra help is most appreciated.

Extra info- Frequent US traveler, however only distant extended family in these cities, no criminal records of any sort. Girlfriend holds Israeli and Russian Citizenship as well as Canadian

From what you are saying, you are not a Hotel Manager and would not qualify for the TN. The definition of Hotel Management for TN standards is not broad, it is actually limited to Hotel Managers and Managers of the Hotel restuarant (the hotel has to own the restuarant to qualify).

However a transfer from Hotel A in Canada to Hotel A in the USA would be fine. L1A or L1B.

Just out of curiosity, can a "partner" not a "spouse" qualify for the work allowance in the US? I read that spouses are without issue able to work under the L1A or L1B? Or do we have to be officially married to qualify? Seems like this is by far the best visa for the hotel employee of management status.

Laws, thank you for your response, very helpful.

Us requires spouse t obe married to get dependant visa status. Non-married psrtners (either sex) can move down with their working partner, but only get a 'accompanying partner" B-2 status, which does not have the same benefits as L2 or even TD or H4, since they cannot work and must maintain foreign residence.
