TN dependant status for Canadians - the process?

Post Fri Jun 04, 2010 8:10 am

I was wondering for the TD status for Canadian citizens, what is required to show at the point of entry beside proof of citizenship and marrige certrificate (birth certificates for children)?

My husband already has TN and he will be with me when I apply for this status.
Do we need a letter from his employer saying that he is still with them (it's been less then 2 months since he got TN)? Do we need copies of any of his TN documents (I-94 etc.), even though he is with me?

Also, for TD status for Canadians, who is approving this status - do I also need to go through the same office my husband did when he got TN, or just the regular officer at the border?

Any experience on how long this usually takes? My husband waited 4 hours for his TN process at the border, I hope this is not the same.

Also, we'll be flying to US, but our furniture and things will be on the truck going to our destination, and that is the main reason my husband is coming here, to help with packing and moving. Moving our things to US - can this create problems for us? It is a temporary move for us for sure, but we do need our things while we are there. But can this be interpreted as intent to immigrate to States?

Thank you.

any time your husband crosses the border, he should have some proof that he is still working: paystub, badge is usually sufficient. he should ALWAYS have his I-94. When travelling within north america he shouldn't have to carry any TN documentation.

So, if he is with you when you get your TD, it would be proper for him to have his paystub or badge, and that should be it. Your passport or birth cert and marriage certificate is all you need. Birth certs and passports for the kids. Get Passports for all of you, it will be much easier.

once you have your I-94s, then you won't need to carry any further documentation.

Anytime an I-94 is issued at border crossing, you go into the office. At the airport he will do it right at the wicket.

Thank you Agnelson, what would we do without you :)

Any thoughts about moving all your stuff to US, would that create any problems with US immigration?

Also, do you know any good US immigration lawyer you can recommend? I'm in that "work remotely from US on TD status for a 100% canadian company" category, and need someone to help me make sure all things are OK.

Also, if you know any good accountant who knows this US/Canada taxes filing rules, that would be great!

Thank you!!

You are allowed to live in US on Tn/TD. Why would bringing your stuff be a problem. You don't need a home in canada.

For a pro to do your taxes, you are looking at $1200+

I'm pretty sure you can do the departure return on your own. The US one is more difficult.
