TN in US less than 6 months

hi, Here is my situation.

I am a canadian just hired by an US californian company on a TN visa.
I am an US employee and paid in USD.

However, I am mostly working from BC, Canada most of my time, I spend less than two months in California.

I was told that I can file 1040 because I am not in US long enough to pay tax. I want to know how it works.

I checked 1040 instructions, I meet all requirements except that my taxable income is more than 100K. Is that mean I can't fill the 1040 form?

What options do i have? Would I end up paying both Canadian and US tax?

Any reference for any accountant with such experience?

You don't use 1040, you use 1040NR and file an 8840 with it.

And then you claim a foreign tax credit using T2209 and T2036 with your T1. The general guide for the T1 explains how to do it.
