I read a memo a while back that came from the White House, suggesting that the length of stay for TN status be extended to 3 years. Has anyone heard any more about this or does anyone know when it might be implemented. I did notice when we got our last one that they made it for 1 year and 3 days to coincide with the actual work start date even though we had gone a few days earlier. The agent said that was their discretion.

Given that (a) the US economy is going down the tubes and (b) NAFTA is a political hot potato and this is an election year, I wouldn't hold your breath.

The 3 years is no longer being mentioned -- doesn't look like this is of importance at this time for the government. We'll see after Apr 01 (H1 visas application date) if this gets revisited.

04/24/2008: Proposed Rule to Change Canadian TN visa Period from One Year(1) to Three Years(3): OMB Approved 04/23/2008

USCIS sought OMB review for this proposed rule on 04/09/2008 and the OMB approved it in two weeks. Probably, this is related to the ongoing North American leaders free trade improvement talk initiated by the President Bush. It is anticipated that this proposed rule be published soon. As usual, this rule making process will still take time since the proposed rule should be published with a certain comment period, after which the USCIS must again draft a final or interim rule reflecting the comments received. The final version will have to then be cleared by the OMB again before this rule is published in the federal register as a legally binding rule which will benefit the border countries' professionals to come to and work in this country on a three-year increment indefinitely. Please stay tuned to this website for the development of this important rule-making process for border country professional workers
