TN Management Consultant - Employer Qualifications

Hello,

On a recent visit to the USA I was offered an employment opportunity to help a psychiatrist in Private Practice develop her business. I recently graduated with my MSc. in Public Management and did my undergrad in International Business.
She would like me in addition to running her daily operations, develop and implement a mid-long term (3-5 year) business plan and a communications and marketing strategy. I was wondering when applying for the TN Management consultant visa - are there any requirements on the side of the employer?- ie. Size of business, # of employees, etc.or is my application for the TN futile because of the type of business she is.
Also, if anyone has a sample employment letter that would be a great help.

That position does not appear to qualify as a management consultant.

To provide a little more clarification on the Mgmt Consultant application, so that if you are able to change you role to meet the requirements - then you may be able to apply.

Here is some info to help you determine it:

Mgmt Consultant applications are a scrutinized occupation.
Officers analyze TN applications to ensure that the applicant is not actually performing another job and/or additional duties for a company under the guise of a "management consultant." Consequently, it is important to thoroughly explain the nature of the consulting work in the application.

Management Consultants are usually independent contractors or employees of consulting firms under contracts to U.S. entities.

If its for full-time employment the management consultant should not be assuming an existing position, replacing someone in an existing position, or filling a newly created permanent position. The job must not be essential to the routine (day to day) operation of the U.S. company. It is a consulting position.

If the position is legitimately that of a Management Consultant, then it is okay for the employer to tailor the letter to describe the position accordingly. So it depends on what the actual duties are.

Hello,

I also have a question about qualifying for the Management Consultant category. I have been offered a job in the USA which entails translation, web design and developing a communications and marketing strategy. I have a Master degree in International Relations, however I have never worked for a consulting firm. Could I still apply as an independent contractor under this category?
